These Everett Vision Center Terms of Use inform you of the terms, conditions, disclaimers, notices, policies, and agreements (collectively, “Terms”) that apply when you (1) access, use or visit our website located at www.everettvisioncenter.com (the “Site”), (2) access or use any of the services offered on the Site, or (3) purchase products or services offered on the Site or in person at our physical location (the Site, services, and products sold by Everett Vision Center are collectively referred to herein as the “Service”).
The Service is provided to you by Everett Vision Center, Inc. (“Everett Vision Center,” “we,” “us” and “our”). BY AFFIRMATIVELY ACKNOWLEDGING YOUR AGREEMENT TO THESE TERMS OF USE, YOU ARE AGREEING TO THESE TERMS, WHICH CONSTITUTE A BINDING LEGAL AGREEMENT BETWEEN YOU AND EVERETT VISION CENTER.
1. AFFIRMATIVE REPRESENTATIONS REGARDING YOUR USE
When you use the Service, you represent that:
- (a) the information you submit is truthful and accurate;
- (b) your use of the Service does not violate any applicable laws or regulations;
- (c) you are at least 18 years of age and a “natural person” in your country of residence.
2. USER ACCOUNTS AND REGISTRATION
- Guest Checkout: You can visit the Site and place orders as a guest, but you will not be able to save your favorites, recently viewed items, or prescription information unless you are a registered user.
- Account Security: If you create a User Account, you are responsible for maintaining the confidentiality of your password and for all activities that occur under your account. You agree to immediately notify Everett Vision Center of any unauthorized use of your account.
- Authorized Use: Everett Vision Center has no obligation to investigate the authorization of any access using your ID and password. You are solely responsible for all financial obligations incurred through your account.
3. PROHIBITED USES
While using the Service, you are prohibited from:
- Using the Site for unauthorized commercial purposes or collecting user data;
- Transmitting viruses, spyware, or any code designed to disrupt the Service;
- Impersonating any person or providing false identification/prescription information;
- Decompiling, reverse engineering, or extracting information from the Site using robots or spiders;
- Posting content that is discriminatory, harmful to minors, or violates the intellectual property rights of others.
4. INTELLECTUAL PROPERTY RIGHTS
All names, logos, text, designs, graphics, and trademarks (including EVERETT VISION CENTER) are owned by or licensed to us.
- Limited License: We grant you a limited, non-exclusive, non-transferable license to access and make personal, non-commercial use of the Site.
- Restrictions: You may not reproduce, duplicate, copy, or sell any part of the Service for any commercial purpose without our express written consent.
5. TERMS OF SALE
- Order Information: To place an order, you must provide accurate shipping info, payment details, frame/lens selection, Pupillary Distance (PD), and valid prescription (Rx) information.
- Prescriptions: We recommend confirming your prescription with your eye care provider if it is more than two years old.
- Delivery: Shipping times are estimates. As eyeglasses are medical devices, orders may be subject to inspections or delays beyond our control. We do not guarantee a specific delivery date.
- Returns: If you are not satisfied, you may return items according to our Return Policy found on the Site.
6. IMPORTANT SAFETY INFORMATION
- Not Medical Advice: No part of the Service should be construed as professional medical or optometric advice. All medical questions should be directed to a healthcare provider.
- Product Safety: Certain materials may cause skin irritation in some users. If irritation occurs, remove the glasses and consult a professional.
- Errors: We do not guarantee that product descriptions, prices, or images are 100% accurate or error-free. Images are for illustrative purposes only.
7. WARRANTY DISCLAIMER AND LIMITATION OF LIABILITY
- “As Is”: The Service and all products are provided “as is” and “as available” without warranties of any kind, express or implied.
- Limitation: To the maximum extent permitted by law, Everett Vision Center shall not be liable for any direct, indirect, or incidental damages. Our total liability shall not exceed $50.00.
- Personal Use Only: All warranties are void if you resell, rebrand, or modify the products (such as placing non-Everett lenses into Everett frames).
8. DISPUTE RESOLUTION AND ARBITRATION
PLEASE READ THIS SECTION CAREFULLY AS IT REQUIRES BINDING ARBITRATION AND WAIVES YOUR RIGHT TO A CLASS ACTION.
- Informal Resolution: You agree to first contact us to attempt to resolve any dispute informally for at least 60 days.
- Binding Arbitration: If unresolved, claims will be settled by binding arbitration administered by JAMS on an individual basis.
- Venue: Any litigation not subject to arbitration shall be filed exclusively in the state or federal courts located in the jurisdiction of our headquarters.
